• RELEASE, WAIVER, INDEMNIFICATION, HOLD HARMLESS AND ASSUMPTION OF RISK AGREEMENT

  WHEREAS, in consideration of being permitted to attend a course for instruction in firearms, for use of the premises and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the Student agrees to the following:The Student agrees to indemnify, hold harmless and defend 10-8 Firearms Instruction and its instructors, training counselors, and range safety officers (hereinafter referred to as “Instructor(s)”) from any and all fault, liabilities, costs, expenses, claims, and demands or lawsuits arising out of, related to or connected with Student’s presence at and/or participation in the course of instruction; the discharge of firearms by Student, Student’s presence on or use of the range, building, land and premises (“Premises”); and, any and all acts or omissions of the Student.

  The Student furthermore waives for himself/herself and for his/her executors, personal representative, administrators, assignees, heirs and next of kin; any and all rights and claims for damages, losses, demands, and any other actions or claims whatsoever, which he/she may have or which may arise against Instructor (including, but not limited to the death of the student and/or any and all injuries, damages, or illnesses suffered by Student or Student’s property), which may, in any way, whatsoever, arise out of, be related to, or be connected with; the course of instruction; the Student’s property (whether or not entrusted to Instructor); and the discharge of firearms. Instructor shall not be liable for, and the Student, on behalf of himself/herself and on behalf of his/her executors, personal representative, administrators, assignees, heirs and next of kin, hereby expressly releases the Instructor from any and all such claims and liabilities. This release and waiver is intended to cover all accidents or injuries of every name, nature or type, if any, which may be sustained or suffered from any cause whatsoever connected with, arising out of, or by reason of participating in this training instruction. The Student understands that the discharge of firearms, armed, or unarmed self -defense training is hazardous and injuries and death may occur.

  The Student hereby certifies and attests that he/she is not a fugitive from justice, or under indictment; that he/she has not been convicted of a felony, domestic abuse, or any other serious crime; that he/she is not drug or alcohol dependent; or that he/she is not under adjudication of mental incompetence. The Student hereby certifies and attests that there is no other reason (in addition to the reasons listed above) that the Student would be prevented from receiving firearms instruction and/or possessing or handling a firearm.

  The Student hereby acknowledges that this is a legal, binding contract and releases Instructor from liability for accident, injury and/or death. The Student expressly agrees that this instrument is intended to be as broad and inclusive as permitted by law, and that if any provision of this instrument is held invalid or otherwise unenforceable, the enforceability of the remaining provisions shall not be impaired thereby. No remedy conferred by any of the specific provisions of this instrument is intended to be exclusive of any other remedy, and each and every remedy shall be cumulative and shall be in addition to every other remedy known or hereafter existing at law or in equity or by statute or otherwise. The election of any one or more remedy hereunder by the Instructor shall not constitute any waiver or Instructor’s right to pursue other available remedies. This instrument shall bind the Student and his/her executors, personal representative, administrators, assignees, heirs and next of kin.

  If the Student is a minor (under the age of 18 years) the Student hereby acknowledges and understands that his/her parent or guardian is required to consent to the Student’s agreement to be bound by each of the conditions identified above. The Student’s parent or guardian has hereby consented to the Student’s agreement to be bound by each of the conditions identified above.

  ELECTRONIC CONTRACTING

  Your use of our website includes the ability to enter into agreements and/or make transactions electronically. YOU ACKNOWLEDGE THAT YOUR ELECTRONIC SUBMISSIONS CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY AND TO PAY FOR SUCH AGREEMENTS AND TRANSACTIONS.   By taking the test for your 10-8 Firearms Instruction certificate of completion and submission of your passing score you are certifying you personally did take all sections of the training, without the aid of another. The score you earned is your true score.

  OUR GUARANTEE

  We guarantee your Certificate of Completion will be accepted by the authority to which your application was submitted. In the event your application is denied due to the nature of our training, we will contact the issuing authority after you have made an attempt to correct the issue yourself. If you cannot correct the issue we will contact the issuing authority directly on your behalf. If we cannot resolve the issue, a full refund will be credited to the account used to purchase the course. We will refund the amount paid to purchase the course only. We will not refund any application fees paid to authority to which your application was submitted or any other expenses incurred during the application process.

  REFUND POLICY
